The Opportunity

The Assistant General Counsel, Global Trade Compliance is responsible for providing strategic and legal guidance regarding Marvell's trade compliance program and leading a global team of professionals responsible for trade compliance and trade operations. This role reports directly to the Vice President, Chief Ethics and Compliance Officer, and will be an integral part of the Ethics and Compliance team responsible for developing and enhancing Marvell's international trade compliance and related programs. This role will partner with many high-level stakeholders to provide guidance on trade compliance regulations, enabling the business to navigate complex trade regulatory landscapes in a compliant and pragmatic way.

Job Responsibilities:

This role is responsible for providing strategic and legal guidance regarding Marvell's global trade compliance program.This includes ensuring compliance with the Export Administration Regulations (EAR), Office of Foreign Asset Controls (OFAC) regulations and programs, economic and trade sanctions programs, Trade Agreement Act (TAA), Customs and Border Protection (CBP) regulations, and other applicable import/export laws and regulations.The role will also provide legal advice and develop compliance programs to comply with emerging laws, including the Uyghur Forced Labor Prevention Act, and partner with stakeholders to design and implement supply chain and third-party due diligence programs.Additionally, this is a management position with day-to-day responsibility for managing Marvell's Global Trade Compliance team.

Successful candidates must demonstrate their ability to:

  • Provide clear and timely legal advice to ensure Marvell complies fully with all applicable trade laws and regulations, including the EAR, OFAC and other sanctions programs, TAA, CBP and other U.S. and international regulations.
  • Provide legal advice and implement compliance programs to ensure Marvell complies fully with BIS export controls, including regulations specific to advanced computing and semiconductor sectors.
  • Advise and lead on drafting of strategic export licenses and other regulatory filings.
  • Lead, manage and provide regular guidance for a global team of trade compliance/ trade operations professionals.
  • Collaborate with various business functions (including colleagues in Legal, Finance/Tax, HR, Engineering, Supply Chain, Marketing and Sales, Corporate Strategy) to understand their business priorities and build integrated, upstream, and forward-looking trade compliance processes.
  • Direct the creation and maintenance of trade compliance policies & guidelines.
  • Implement technology tools to streamline and enhance trade compliance operations.
  • Direct the development of our trade compliance program's continuous improvement activities, including compliance assurance and risk assessment programs.
  • Monitor legal, regulatory, and trade developments that impact Marvell's business and deliver clear and timely legal guidance to mitigate impacts.
  • Direct, develop and execute risk-based trade compliance trainings and communications.
  • Lead projects to enhance trade compliance efficiency and value contribution.
  • Lead the development of trade compliance roadmap and strategic planning.
  • Assume responsibility for emerging risk areas, including providing legal analysis and developing compliance strategy.
  • Promote a business culture of trade compliance and ethics and perform other compliance activities.

Requirements:

Qualifications

  • Juris Doctorate degree from accredited law school
  • Licensed to practice law in United States (California, Texas or Washington D.C., preferred)
  • 10+ years of experience in advising multinational businesses on trade compliance matters, including U.S. export controls and sanctions programs; semiconductor industry (or closely related fields) preferred.

Required Skills and Experience

  • Experience in building and leading a trade compliance function in a multinational company.
  • Strategic thought leader with business acumen and ability to provide legal advice based on sound judgment.
  • Excellent and effective written and verbal communication skills, most importantly the ability to distill complex legal concepts into simple terms easily digestible by business.
  • Strong presentation skills.
  • Deep expertise in U.S. export controls and sanctions regulations.
  • Knowledge of import compliance including Country of Origin determinations, valuation and HTS classifications, and tariff programs.
  • Excellent legal research and writing skills.
  • Experience in managing outside counsel and budgets.
  • Experience in working, managing, and driving multi-functional projects to completion.
  • Flexible, hardworking team player able to understand operational needs and design pragmatic and compliant solutions.
  • Motivator with strong people and management skills and the skills to develop, train and grow a team.
  • Attention to detail, critical thinking, excellent problem solving and analysis skills.
  • Nimble learner and quick to learn new and different technologies and stay abreast of emerging technologies; technical/engineering background, a plus.
  • Experience with ethics and compliance program management and/or development, a plus.

Expected Base Pay Range (USD)

155,040 - 232,200, $ per annum

The successful candidate's starting base pay will be determined based on job-related skills, experience, qualifications, work location and market conditions. The expected base pay range for this role may be modified based on market conditions.
