The Litigation Counsel is responsible for providing a wide range of in-house legal services for eXp Realty, LLC. Primary areas of focus to include: managing litigation including conferring with outside counsel, developing litigation strategy, determining settlement value, facilitating outside counsel in responding to discovery requests, providing advice concerning legal issues that arise during real estate transactions and operation of a real estate brokerage, analyzing and responding to demand letters, cease and desist letters, and other similar correspondence, drafting demand letters, cease and desist letters, and other similar correspondence, facilitating compliance with regulatory requirements, responding to or assisting in the response to regulatory complaints, contract review and administration, and assisting with compliance and training.

This role requires a strategic thinker with strong attention to detail and significant experience collaborating with a variety of operational groups in a fast-paced environment of innovation. A qualified candidate must be able to operate with a high case volume and successfully shift attention between lower value and higher value matters.

Major Duties and Responsibilities

* Performance-driven leadership and accountability of litigation matters for the company with the ability to work collaboratively, manage independently, and overcome obstacles to produce results in a timely fashion.
* Judge the merits of claims and court cases filed against or on behalf of the company, work with the appropriate business partner(s) to define a strategic defense, and approve settlements of disputes where warranted.
* Oversee the selection, retention, management, and evaluation of all outside counsel.
* Provide strategic and proactive legal advice and counseling.
* Develop and maintain strong business relationships as a key relationship manager for the legal department among the various internal business groups requiring litigation support.
* Provide a balanced and integrated aspect of both business and law, while advising the company on litigation risks of possible business decisions and managing litigation.
* Demonstrate leadership and team-working skills in support of a collaborative environment.
* Oversight of paralegals and other legal staff.
* Provide legal guidance and advice on the interpretation, implementation, and administration of policies and procedures; draft memoranda, contracts, policies, procedures, education and training material, and legal documents as needed.
* Prepare responses to complaints/claims filed with federal, state, and/or municipal agencies or courts, as well as third-party organizations.
* Perform legal research, analyze, organize, and strategize effectively.
* Contribute to Legal team efforts to improve internal process and efficiency.
* Exercise discretion and independent judgment commensurate with specialized legal skills and experience.

* Perform other duties as required.

Required Experience

* 3-9 years experience in a law firm environment as a practicing litigation lawyer, preferably with a regional or national law firm before moving to an in-house position.
* Experience managing a high caseload with competing priorities in-court experience, including arguing motions, small claims or regular civil trials, and representing clients in mediation.
* Prior experience in advising clients on various options in litigation and providing recommendations based on the client's goals and cost required for each option.
* Strong leadership and communication skills - written and verbal - to work with senior executives across various geographies and functions; comfortable in business and technical discussions.
* Ability to make recommendations and difficult decisions to implement best practices.
* Experience drafting and revising legal documents.
* Ability to manage competing priorities.
* Strong analytical skills to work on complex business issues with minimum supervision.
* Strong research and analysis skills.
* Ability to adapt quickly and learn new tasks independently.
* Results-driven with the ability to meet deadlines.
* Computer skills in Google, Microsoft, and Adobe products. Overall comfortability with technological resources a must.
* Ability to influence, negotiate, and hold teams accountable to execute.
* Ability to work independently and in ambiguous situations.
* Ability to work from home/remotely.
* Understanding of public relations results of litigation and pre-litigation decisions.

Ideal Additional Experience

* Prior experience in real property law, including residential real estate transactions, business law, agency law, and contract law.
* Experience with cost-effective management of outside legal resources.
* Experience drafting and revising policies and procedures.
* Familiarity with Trello, Workplace, Facebook Messenger or other instant messaging applications.
* Experience working with consumer protection laws, RESPA, the TCPA, and fair housing laws.
* Experience with data privacy laws, insurance coverage, intellectual property litigation, or labor and employment issues.

Education

* Juris Doctorate from a law school accredited by the American Bar Association
* Admission to at least one state bar and currently in good standing.
